Terms, Privacy & Disclaimers

These terms govern your use of Shisha Traders (“Shisha Traders”, “Shisha Engine”, “we”, “us”, “our”). By accessing or using anything we offer, you agree to all of them. If you don’t agree, don’t use our services.

Effective date: June 17, 2026

PLEASE READ — THIS IS A BINDING AGREEMENT.

By creating an account, subscribing, joining our Discord, watching our streams, or using our software, you agree to everything below, including the no-refund policy, the limitation of liability, and the release of claims. You use everything we offer at your own risk.

Risk Disclaimer

TRADING FUTURES, FOREX, OPTIONS AND OTHER LEVERAGED INSTRUMENTS INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR EVERYONE. YOU CAN LOSE SOME, ALL, OR MORE THAN YOUR DEPOSIT.

By using anything we offer, you acknowledge and agree that:

  • Leverage works against you as well as for you; losses can exceed your initial capital.
  • Past performance — including any results, streaks, or win-rates we show — is NOT a prediction of future results.
  • Any performance shown may be hypothetical or simulated; hypothetical results have inherent limitations and do not reflect real trading. No claim is made that you will achieve similar results.
  • We are a technology and education provider only. We are NOT a broker, NOT a financial or investment adviser, and we do NOT give personalized financial, investment, tax, or legal advice.
  • Every trade, setting, and outcome is your own decision and your own responsibility.
  • You should only trade with money you can afford to lose.

Earnings & Results Disclaimer

Any statement about performance, profitability, win-rate (including figures like “157 of 159”), income, or results — whether mine, an analyst’s, or a member’s — describes an individual experience and is not typical, not a promise, and not a guarantee of any outcome for you.

  • Your results depend on factors outside our control — your skill, discipline, risk management, market conditions, broker execution, and capital.
  • Testimonials and live-session results are individual experiences and are not what an average person should expect.
  • We do not guarantee any profit or income, and we do not guarantee you will not lose money. Most traders lose money.

Terms of Use

1. Who can use this

You must be at least 18 years old and legally able to enter this agreement. Our services are not directed to anyone where using them would be unlawful.

2. What the software does

Shisha Engine executes orders strictly according to YOUR settings and the third-party signals/alerts YOU connect. It is for automation and education only. It does not give advice, does not generate signals on its own, and needs your active setup and monitoring.

3. No financial advice

Nothing we provide — software, indicators, courses, streams, Discord content, or messages — is financial, investment, trading, tax, or legal advice, or a recommendation to buy or sell anything. It is all informational and educational.

4. Your license

We grant you a limited, personal, non-transferable, revocable license to use our services for your own use. You may not share, resell, sublicense, copy, reverse engineer, or modify our software or content.

5. Your account & security

You are responsible for your login details, API keys, broker access, and everything done under your account. We are not responsible for losses from unauthorized access or compromised credentials.

6. Billing & auto-renewal

Subscriptions are billed through our payment processor (Whop) and automatically renew until you cancel. You authorize recurring charges. We may change prices or features going forward; continued use means you accept the change. You are responsible for any applicable taxes.

7. Fair use

You agree not to:

  • Share, resell, or transfer your access; reverse engineer or modify the software.
  • Use our services for anything unlawful, fraudulent, or abusive.
  • Break any broker, exchange, prop-firm, or platform rules.
  • Bypass subscription, security, or usage limits, or disrupt the service or other users.

8. Suspension & termination

We may suspend or end your access at any time, with or without notice, for any reason — including breaking these terms, suspected fraud, or chargebacks. When access ends, your license ends. No refund is owed.

No-Refund Policy — All Sales Final

EXCEPT WHERE A REFUND IS REQUIRED BY LAW THAT CANNOT BE WAIVED, ALL SALES ARE FINAL AND ALL FEES ARE NON-REFUNDABLE.

Free trial

The free trial lets you evaluate everything before paying. Cancel before it ends and you won’t be charged. If you don’t cancel, it converts to a paid subscription and recurring billing begins.

No refunds

Once a paid charge is made, we do not give refunds, in whole or part, including:

  • No refunds for trading losses or lack of profit.
  • No refunds for change of mind, non-use, or buyer’s remorse.
  • No refunds for user error, misconfiguration, or forgetting to cancel.
  • No refunds for technical issues on your side (hardware, internet, broker, platform).
  • No refunds for partial billing periods or unused time after cancellation.

Cancellation

Cancel anytime in your account or through the processor; your access continues until the end of the period you already paid for. No partial refunds.

Chargebacks

Filing a chargeback instead of contacting us is a breach of these terms and will permanently end your access. We will dispute it and may submit this agreement and your usage records as proof you agreed and received access.

Disclaimer of Warranties

EVERYTHING IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

To the fullest extent allowed by law, we disclaim all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, accuracy, reliability, uptime, and uninterrupted or error-free operation. Software can have bugs, latency, downtime, connectivity failures, or order-execution errors. You use it at your own risk.

Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW:

  • We are not liable for any trading or investment losses of any kind, ever.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities — even if we were warned they were possible.
  • We are not liable for losses caused by software bugs, downtime, latency, internet or connectivity failures, third-party platforms, brokers, prop firms, events outside our control, or your own settings and decisions.
  • If we are ever found liable despite the above, our total liability for any and all claims will not exceed the greater of (a) what you paid us in the one (1) month before the claim arose, or (b) USD $50.

Some places don’t allow certain limitations; where that’s the case, our liability is limited to the smallest amount the law allows.

Assumption of Risk & Release

You knowingly and voluntarily accept all risks of trading and of using automation software, and you agree that you alone are responsible for your trades and their outcomes.

To the fullest extent allowed by law, you release and agree not to hold Shisha Traders, its operator, and anyone acting on its behalf responsible for any loss, damage, or claim arising from your trading, your use of our software, indicators, streams, or course, or your reliance on anything we provide. You also agree to cover (indemnify) us for any claim brought by a third party because of your use or your violation of these terms.

Privacy Policy

What we collect

  • Account info: email, username, and login identifiers.
  • Billing info: subscription and payment details, handled and stored by our processor (Whop) — we do not store full card numbers.
  • Usage data: logs and basic device/browser data used to run and improve the service.
  • Discord identifiers if you join our server.

What we don’t collect

We do not store your broker passwords, balances, or trading positions on our servers. Trading happens between your device, your broker, and your trading platforms.

How we use it

To run, secure, and improve the service; process payments; provide support; send you service and (where allowed) promotional messages; and prevent fraud and abuse.

Who we share it with

Only the providers we need to operate — such as Whop (payments), hosting, basic analytics, and Discord — and only as required by law. We do not sell your personal information.

Your choices

You can ask us to access, correct, or delete your personal data, and you can unsubscribe from promotional email anytime. Email support@shishatraders.net and we’ll help.

Security, retention & minors

We use reasonable safeguards, but no system is perfectly secure. We keep data while your account is active and as needed for legal and operational reasons. Our services are not for anyone under 18, and we don’t knowingly collect data from minors.

Email & Communications

By giving us your email or signing up, you agree to receive messages from us — including service messages (receipts, security, important notices) and, where allowed, promotional messages. We keep email honest and easy to leave:

  • We use accurate sender and subject information — no deceptive headers or subject lines.
  • Promotional emails make clear they’re promotional and always include a way to opt out.
  • One click on the unsubscribe link stops promotional email; we honor opt-outs promptly. You can also email support@shishatraders.net. Service/transactional messages may still be sent.

Trademarks & Third-Party Companies

Logos and names of proprietary trading firms, brokerages, platforms, and signal providers we reference are the property of their respective owners and are used only to describe what our software works with. Shisha Traders is NOT affiliated with, sponsored by, or endorsed by any of them, and we don’t endorse them.

• TradingView and the TradingView logo are trademarks of TradingView, Inc.

• NinjaTrader and related marks are trademarks of NinjaTrader Group, LLC and its affiliates.

• Tradovate and related marks are trademarks of Tradovate Holdings LLC and its affiliates.

• Whop is a trademark of its respective owner and is our payment processor.

• All other marks are the property of their respective owners.

General

  • Changes. We may update these terms anytime. Changes take effect when posted; continued use means you accept them.
  • Severability. If any part is found unenforceable, the rest still applies in full.
  • No waiver. If we don’t enforce a term right away, we don’t give up the right to enforce it later.
  • These survive. The disclaimers, no-refund policy, liability limits, and release stay in effect even after you stop using our services.
  • Talk to us first. If you have a problem, email us before anything else — most things are solved in minutes.
